Who we are
Level Up Media Group LLC (“Level Up Media Group,” “we,” “us,” or “our”) is a Florida limited liability company that provides digital marketing and awareness services, including SMS, email newsletter, influencer, advertising, content, and social media campaigns, mainly for public companies. This Privacy Policy explains how we collect, use, share, and protect personal information when you visit levelupm.com (the “Site”), contact us, join a text-message or email program we operate, or work with us.
Questions about this policy: contact@levelupm.com.
What this policy covers
This policy covers personal information we handle through the Site, through email and other communications with us, through text-message and email programs we operate, and in business relationships with clients, vendors, and partners.
It does not cover third-party websites, platforms, or services we link to or publish on, such as social networks, newsletters operated by others, video platforms, and ad networks. Those services have their own privacy policies. When we process personal information for a client under a written agreement, that agreement governs our handling of it, and the client’s own privacy notice applies.
Information we collect
Information you give us
- Contact details: name, email address, company, job title, and phone number if you share it.
- Inquiry details: your company’s ticker, the services you’re interested in, your timeline, and anything you write to us.
- Program sign-ups: if you opt in to a text-message or email program we operate, your mobile number or email address, the date, time, and method of your opt-in, and the program you joined.
- Business relationship information: contract, billing, and correspondence records for clients, vendors, and partners.
How the contact form works
The contact form on the Site does not send your information to our servers. When you select the button, the form prepares an email in your own email app, addressed to us. Nothing is sent until you press send in that app, and we receive the information only if you send it.
Information collected automatically
The Site is delivered through a hosting and content delivery provider (currently Cloudflare). When you visit, that provider processes technical information needed to deliver and protect the Site, such as your IP address, browser and device type, the pages requested, the referring URL, and the date and time. We may view aggregated, privacy-focused traffic statistics that do not use cookies or identify individual visitors. The Site does not use advertising pixels, cross-site tracking, session recording, or fingerprinting.
When you click a tracked link in a message we send, we may record that the link was clicked, when, and from what type of device, to measure campaign performance.
Cookies
The Site itself does not set cookies. Our hosting provider may set strictly necessary security cookies. See our Cookie Policy.
Information from other sources
We may collect business contact information from public sources, such as company websites, public filings, press releases, and professional networking profiles, when we research companies we may work with.
Text messages (SMS)
If you opt in to a text-message program operated by Level Up Media Group, we collect your mobile number, your consent record, the messages we send you, your replies (such as STOP or HELP), and delivery and click data. We use this information only to send you the messages you agreed to receive, to honor opt-out and help requests, to keep records of consent, and to measure and improve the program.
We do not share, sell, or provide your mobile phone number or text-messaging consent data to third parties or affiliates for their marketing or promotional purposes. We disclose mobile information only to service providers that deliver messages on our behalf, such as messaging platforms and carriers, or when required by law.
Message frequency varies by program. Message and data rates may apply. Reply STOP to cancel at any time, or HELP for help. You can also email contact@levelupm.com. See the text-message section of our Terms of Service.
How we use information
We use personal information to:
- respond to inquiries, schedule calls, and prepare proposals;
- run, measure, and improve our services, programs, and the Site;
- send messages you have asked to receive, with a working way to opt out;
- communicate with clients, vendors, and partners about engagements;
- keep records needed for compliance, including consent, disclosure, and publication records;
- protect the Site, our business, and others against security threats, fraud, and abuse; and
- comply with legal obligations and respond to lawful requests from authorities.
We do not use personal information for automated decision-making that produces legal or similarly significant effects.
Legal bases for processing (EEA and UK visitors)
If data protection laws in the European Economic Area or United Kingdom apply to you, we rely on: performance of a contract or steps you asked for before entering one; our legitimate interests in operating and promoting our business, responding to inquiries, and securing the Site, balanced against your rights; compliance with legal obligations; and your consent where we ask for it, which you may withdraw at any time.
How we share information
We do not sell personal information, and we do not share it for cross-context behavioral advertising. We share personal information only with:
- Service providers that host the Site, deliver text messages and email, or provide business tools, under obligations to protect the information and use it only to provide their services;
- Professional advisers such as lawyers and accountants, under confidentiality obligations;
- Clients and their advisers, when needed to deliver services you are involved in, for example coordinating a client’s content approvals (this never includes mobile numbers or text-messaging consent collected for our programs);
- Authorities and others when required by law, subpoena, or regulatory request, or to protect rights, property, or safety;
- A successor business in a merger, acquisition, or sale of assets, subject to confidentiality protections and this policy; and
- Anyone else with your consent or at your direction.
None of these disclosures involves sharing mobile numbers or text-messaging consent with third parties or affiliates for their marketing or promotional purposes.
How long we keep information
We keep personal information only as long as needed for the purposes in this policy. Inquiries that don’t lead to an engagement are kept only as long as reasonably needed to follow up. Consent and opt-out records for messaging programs are kept for as long as needed to prove consent and honor opt-outs under applicable law. Client and engagement records are kept for the length of the relationship and afterward as needed for legal, tax, accounting, and regulatory purposes or to resolve disputes.
How we protect information
We use reasonable administrative, technical, and physical safeguards, including encrypted connections (HTTPS) for the Site, strict security headers, access controls, and limiting access to people who need it. No method of transmission or storage is completely secure. Email is not always encrypted end to end, so please don’t send sensitive personal information, such as government ID or financial account numbers, by email or through the contact form.
Your privacy rights and choices
Depending on where you live, you may have the right to know what personal information we hold about you and get a copy, correct it, delete it (subject to legal exceptions), object to or restrict certain processing, receive it in a portable format, opt out of marketing messages, the sale of personal information, targeted advertising, and certain profiling, and appeal our decision on a request.
To make a request, email contact@levelupm.com with the subject line “Privacy request.” We will verify your request using information you have already provided and respond within the time required by law, generally within 45 days. You may use an authorized agent where the law allows. We will not discriminate against you for exercising your rights. If we deny your request, you may appeal by replying to our decision, and if you are not satisfied, you may contact your state attorney general or local data protection authority.
California residents
In the past 12 months we have collected identifiers and contact details, professional information, internet or network activity processed by our hosting provider, link-click data from our messages, and the contents of communications you send us, from the sources and for the purposes described above, and we disclosed them only to the recipients listed in “How we share information.” We have not sold or shared personal information as those terms are defined under California law, and we do not knowingly sell or share the personal information of consumers under 16. We do not use sensitive personal information for purposes that require a right to limit. “Shine the Light” requests may be sent to contact@levelupm.com.
Opting out of messages
Reply STOP to any text message to stop texts from that program. Use the unsubscribe link in any marketing email, or email contact@levelupm.com. We may still contact you about an existing business relationship.
Do Not Track and Global Privacy Control
The Site does not track visitors across third-party websites, so it treats all visitors the same whether or not a Do Not Track signal is sent. We honor Global Privacy Control signals as a request to opt out of the sale or sharing of personal information for that browser. Because we don’t sell or share personal information, no further action is needed.
International visitors
We are based in the United States, and the Site is hosted on a global network. If you contact us from outside the United States, your information will be processed in the United States and other countries where our service providers operate, which may have different data protection laws than your own.
Children’s privacy
The Site and our programs are intended for adults. They are not directed to children under 16, and we do not knowingly collect personal information from children under 16. Text-message programs we operate are for people 18 and older. If you believe a child has given us personal information, email us and we will delete it.
Third-party sites and platforms
The Site links to third-party websites, and our campaigns appear on third-party platforms such as social networks, newsletters, video sites, and ad networks. We don’t control those services, and their own privacy policies apply.
Changes to this policy
We may update this policy from time to time. We will revise the “Last updated” date at the top of this page and, for material changes, provide a more prominent notice on the Site. Changes take effect when posted.
